State Water Resources Control Board Emergency Regulations
On May 9, 2016, Governor Brown issued Executive Order B-37-16 “Making Water Conservation a Way of Life” calling on the State Water Resources Control Board (State Board) to adjust emergency water conservation regulations through the end of January 2017 in recognition of the differing water supply conditions across the state.
In response to this Executive Order, on May 18th the State Board adopted an emergency Resolution and issued a self-certification procedure by which water suppliers may define an individualized conservation standard based upon an assessment of their individual projected water supply and demand conditions for the following three years.
This new approach mandates each retail agency to conduct a “stress test,” certifying whether they have sufficient available potable supplies for a three-year period under high demand and low precipitation conditions to meet the needs of their customers. Water agencies that face shortages under three additional dry years are required to meet a conservation standard equal to the amount of shortage. This replaces the prior percentage reduction-based water conservation standard.The City of Fountain Valley completed the “Stress Test” and submitted documentation to the State Board in June 2016. The City of Fountain Valley relied upon calculations provided by the Municipal Water District of Orange County (MWDOC) and the Orange County Water District (OCWD) to determine the available supply of both imported and groundwater supply for this time period (see below).

While the “stress test” resulted in a zero percent standard for Fountain Valley, a cautious approach is warranted with conservative and prudent water resource management. Therefore, the City of Fountain Valley calls for continued efficiency measures from June 1, 2016, through January 31, 2017, that will achieve a water savings goal of approximately 10% when compared to water consumption in 2013, the State Board’s base year for measurement.
